A RESOLUTION OF THE MAYOR AND COUNCIL OF THE CITY OF NORTH PLATTE, LINCOLN COUNTY, NEBRASKA, STATING THAT THE
CITY OF NORTH PLATTE IS CONSIDERING THE ANNEXATION OF PARCEL ID NUMBERS 0054295.00, 0053770.00, 0053775.0,
0053535.00, 0053780.00, 0053560.00, 0060270.00, 059215.00, 060275.00, 0058875.0, 0059090.00, 0059106.00,
0060860.00, 0058880.00, 0058860.00, 0058870.00, 0058885.0, 0058900.00, 0058895.00, 0058910.00, 0058920.00,
0058850.00, 0058915.00, 0058855.0, 0059095.00, 0058925.00, 0058890.00 AS SURVEYED, PLATTED, AND RECORDED
BY THE LINCOLN COUNTY REGISTER OF DEEDS; DESCRIBING BOUNDARIES OF THE LAND PROPOSED FOR ANNEXATION;
APPROVING AND ADOPTING A PLAN FOR EXTENDING CITY SERVICES TO THE LAND PROPOSED FOR ANNEXATION, AND MAKING
THE PLAN AVAILABLE FOR INSPECTION; PROVIDING FOR A PUBLIC HEARING DATE, TIME AND LOCATION ON THE PROPOSED
ANNEXATION; PROVIDING FOR PUBLICATION OF NOTICE OF SUCH HEARING AND OF THE MAP DRAWN TO SCALE DELINEATING
THE LAND PROPOSED FOR ANNEXATION; AND PROVIDING FOR NOTICE TO UTILITY COMPANIES, SID CLERKS, FIRE DISTRICT,
AND LANDOWNERS OF THE PROPERTY WITHIN THE PROPOSED AREA, AND PROVIDING FOR DELIVERY OF A COPY OF THIS
RESOLUTION TO ANY SCHOOL DISTRICT WITHIN THE AREA PROPOSED TO BE ANNEXED, AND TO THE PLANNING COMMISSION
FOR RECOMMENDATION. PASSED THIS 4™ DAY OF JANUARY, 2022.
The Mayor and Council of the City of North Platte, Lincoln County, Nebraska met at regular session in the Council Chambers on
the 4th day of January. 2022.
The following Council members were present: Nislev. Trvon. Volz. Lucas. Garrick. Carman. Rieker. Woods.
The following Council members were absent: None.
Mayor Brandon Kelliher presided and the City Clerk Angela Gilbert recorded the proceedings. It was moved by Nislev that the
following resolution be adopted:
WHEREAS, the City of North Platte desires to annex certain land, and
WHEREAS, the Nebraska Revised Statutes Section 16-117 requires the City Council to adopt a resolution stating that the City is
considering the annexation of land and a plan for extension of City services to said land.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of North Platte as follows:
1. The City of North Platte is considering annexation of property more particularly described as follows:
Study Area 2021-1 (Erickson - North of Hwv 30 and West of Newberry): All of that part of Lot 2, Briggs Subdivision, North
Platte, Lincoln County, Nebraska lying north of the northerly Highway 30 right-of-way and west of the westerly Newberry
Access right-of- way and that part of Section 35, Township 14 North, Range 30 West of the 6th P.M., lying south of the southerly
Union Pacific Railroad right-of-way, west of the westerly Newberry Access right-of-way and east of the east line of Lot 2, Briggs
Subdivision.
Study Area 2021-2 (Croell - North of Hwv 30 and East of Newberry): All of that part of Section 2, Township 13 North, Range 30
West of the 6th P.M., Lincoln County, Nebraska and that part of Section 35, Township 14 North, Range 30 West of the 6th P.M.,
Lincoln County, Nebraska lying south of the southerly Union Pacific Railroad right-of-way, east of the easterly Newberry Access
right-of-way, north of the northerly Highway 30 right-of- way and west of a line described as the right bank of the North Platte
River in Instrument 201900992 at the Lincoln County Register of Deeds (said tract includes Parcels 5 and 6 in said document)
Study Area 2021-3 (Airport - South of Hwv 30V All of that portion of Section 36, Township 14 North, Range 30 West of the 6th
P.M. and Section 1, Township 13 North, Range 30 West of the 6th P.M., Lincoln County Nebraska lying south of the southerly
Highway 30 right-of-way and northeasterly of the north bank of the North Platte River (the high bank of said parcel is
described in Book 61, Page 528 at the Lincoln County Register of Deeds) AND All of that part of Section 6, Township 13 North,
Range 29 West of the 6th P.M., Lincoln County, Nebraska lying south of the southerly Highway 30 right- of-way and includes
the accretions to Government Lots 6,7, and 8 in said Section 6 AND All of that part of Section 31, Township 14 North, Range
29 West of the 6th P.M., Lincoln County, Nebraska lying south of the southerly Highway 30 right-of-way. AND Government Lot
1 and the accretions thereto in Section 7, Township 13 North, Range 29 West of the 6th P.M., Lincoln County, Nebraska AND
Government Lots 1,2,3 and 4 and the accretions thereto in Section 8, Township 13 North, Range 29 West of the 6th P.M., Lincoln
County, Nebraska AND All of Section 5, Township 13 North, Range 29 West of the 6th P.M., Lincoln County, Nebraska lying south
of the Highway 30 right-of-way AND The West 400 Feet of that part of the Southwest Quarter of Section 4, Township 13 North,
Range 29 West of the 6th P.M., Lincoln County, Nebraska lying south of the southerly Highway 30 right-of-way (said parcel
described in Book 280, Page 482 at the Lincoln County Register of Deeds) AND The West 400 Feet of the Northwest Quarter,
the West 400 Feet of Government Lot 1 and the accretions thereto in Section 9, Township 13 North, Range 29 West of the 6th
P.M., Lincoln County, Nebraska. AND that part of Section 36, Township 14 North, Range 30 West of the 6th P.M., Lincoln County,
Nebraska including Government Lot 1 and the accretions thereto lying north of the northerly Highway 30 right- of-way and
south of the southerly Union Pacific Railroad right-of-way.
2. That the plan of the City for the extension of City services to the above land proposed for annexation, as presented
at this meeting, and incorporated herein by this reference, be and the same herby is adopted and approved, subject
to any changes by the City Council after public hearing on the proposed annexation and recommendations from the
Planning Commission, and is available for inspection during regulation business hours in the office of the City Clerk,
located at 211 West Third Street, North Platte, Nebraska.
3. That a public hearing on the proposed annexation at which the City Council shall receive testimony from any interested
persons shall be held on the 15th day of February, 2022, at the hour of 5:30 PM in the Council Chambers of the City
of North Platte located at 211 West Third Street, North Platte, Nebraska.
4. That a copy of this Resolution and a map drawn to scale and delineating the area proposed to be annexed shall be
published in the official newspaper of the City at least once not less than ten (10) days preceding the date of the public
hearing.
5. That a copy of this Resolution be mailed by first class mail following its passage to the school board of any school district
in the land proposed for annexation.
6. That required notices will be provided to utility companies, SID Clerks, fire districts, school districts, and owners of the
property as required by applicable statutes.
7. That a copy of this Resolution be forwarded to the Planning Commission for recommendation following its passage.
The resolution having been considered in its entirety, the motion for its adoption was seconded by Garrick. Upon roll call vote:
Council members voting in favor: Nislev. Volz. Lucas. Garrick. Caiman. Rieker.
Council members voting in opposition: Trvon. Woods.
Council members absent: None.
Mayor Kelliher thereupon declared the resolution carried.
